SnekQ End User License Agreement
Draft for attorney review before public release. This custom EULA supplements applicable Apple App Store terms.
License
Handi Inc grants the user a limited, personal, revocable, nonexclusive, nontransferable license to install and use SnekQ on supported Apple-branded devices controlled by the user, solely for lawful personal use and subject to the subscription and service terms.
Restrictions
The user may not copy or redistribute the app except as Apple permits, rent or resell access, bypass subscription or authentication controls, reverse engineer protected components except where law expressly allows it, automate bulk identifications, scrape content or reference imagery, extract datasets, remove SnekQ attribution from generated share assets, submit malicious reports, or use SnekQ to create or train a competing identification product.
Ownership
SnekQ, its software, interfaces, brand, curated content, generated educational artwork, database structure, and service components are owned by Handi Inc or its licensors. The license does not transfer ownership. Third-party reference assets remain subject to their respective licenses.
User content
The user retains rights in submitted photos and notes. The limited processing and confirmed inaccuracy-report licenses are described in the Terms and Privacy Policy.
Safety and no professional reliance
SnekQ is not emergency, medical, veterinary, legal, or wildlife-control advice. It does not guarantee an identification and never authorizes touching or handling a snake. A suspected bite requires immediate emergency or Poison Control contact without waiting for the app.
Maintenance and support
Handi Inc is responsible for SnekQ maintenance and support to the extent required by applicable law. Apple has no obligation to furnish maintenance or support services for SnekQ.
Warranty and product claims
To the maximum extent permitted by law, SnekQ is provided without warranties beyond those that cannot legally be excluded. Handi Inc, not Apple, is responsible for addressing claims relating to the app, including product liability, legal compliance, and consumer-protection claims.
Intellectual-property claims
If a third party claims that SnekQ or the user’s possession and use of SnekQ infringes intellectual-property rights, Handi Inc, not Apple, is responsible for investigating and resolving the claim as required by law.
Compliance
The user represents that they are not located in a country subject to a United States government embargo or designated as supporting terrorism and are not listed on a United States government prohibited or restricted-party list.
Third-party beneficiary
Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against the user upon acceptance.
Termination
The license ends automatically if the user materially violates this EULA. Upon termination, the user must stop using and delete the app, subject to applicable consumer rights.
